Why the Most Ethical Thing I Do in My Business is Say "No" to Filing Your Trade Mark

As founders and business leaders, we are constantly bombarded with advice about delegation. We are told to hand over the tasks that drain our energy, to free up our time, and to live by my own mantra: "You can do anything, but you shouldn’t have to do everything."

And for the most part, that is excellent advice. Handing over your inbox, streamlining your calendar, or outsourcing your operational workflows is how you reclaim your sanity and your billable hours.

But there is a line where smart delegation can accidentally cross into legal risk.

In the last few years, I’ve noticed things that makes me raise an eyebrow; where business owners are asking general Virtual Assistants to file their trade mark applications, and (I think) worse, is VAs offering "trade mark registration" as a standard, low-cost service package.

To be absolutely clear: no shade to anyone here. You don’t know what you don’t know. There is no shame in that. But when it comes to protecting your intellectual property, this is a classic case of a little bit of knowledge becoming dangerous in my view.

Here is why one of the most ethical things I do in my business support agency is say "no" to filing trade marks and why you should be very careful about who you trust with your brand assets.

Yes, I have the qualifications. (But I still won't do it.)

If you’ve looked at my background, you might find this stance surprising.

I’m not a generalist who is unaccustomed to legal paperwork. I am a qualified trade mark paralegal and senior legal EA who has supported senior leaders and law firm partners/Heads of Practice. I have spent years walking the halls of major international law firms, working alongside brilliant lawyers and partners, and managing complex global portfolios. I know the systems, I am familiar with national registries, and I absolutely can file a trade mark application.

But if you ever ask me to help with yours, you’ll find that I will gently but firmly decline, and encourage you to speak with a specialist instead, (or if you really are bootstrapping, I’ll briefly explain the best way through the DIY process at the UKIPO (though I do prefer that you at least speak to a trade mark attorney!)).

Protecting your brand is never just about "filling in a form".

Why VA filed trade marks might become a liability

Filing the application is simply the very last step in a much larger, highly strategic legal process. When a qualified trade mark professional protects your brand, they aren't just paying a registry fee. They are doing the vital groundwork that ensures your registration reflects your brand and logo.

Here is what a specialist chartered trade mark attorney does before they even touch an application form:

  1. Comprehensive Clearance Searches: They don't just check if your exact name is free on Google. They search registry databases for similar names, phonetic matches, and potential conflicts that could lead to an expensive opposition.

  2. In-Depth Risk Assessment: They identify potential roadblocks early, helping you understand the likelihood of your application being rejected by the registry or challenged by an existing brand.

  3. Strategic Specification Drafting: This is where things get highly technical. Trade marks are registered under specific "classes" of goods and services. A specialist drafts specifications that protect how you actually use your mark today, while leaving room for where your business is expanding tomorrow.

  4. Objection Preparation: If (or when) the registry raises an objection, a qualified professional knows exactly how to respond, defend your application, and navigate complex legal arguments.

That depth of knowledge only comes from years of legal training and daily practice. It is not something anyone can pick up from filing a handful of basic applications without proper training, supervision, and guidance.

The foundation, not the extra

Think of it this way: roughly speaking, investing in proper IP protection and investing in high-quality brand assets sit in the exact same bracket.

Both are the absolute foundations of your business, not optional "nice-to-have" extras.

If you register a trade mark incorrectly by using the wrong classes, an overly narrow specification, or without clearing the name first, you may not be as protected with your brand assets as you think.

And years down the line, if you eventually decide to exit, license, or sell your business, your buyers will audit your intellectual property. You will be incredibly glad you got your ducks in a row and your IP house in order with a qualified specialist from day one.
